Notice of Public Hearing-Local Law No. C-2026 Regulating Battery Energy Storage Systems on October 7, 2026, at 6:30 p.m.
NOTICE OF PUBLIC HEARING
TOWN OF MARCELLUS
NOTICE IS HEREBY GIVEN that pursuant to Municipal Home Rule Law there has been presented to the Town Board of the Town of Marcellus, New York, at a regular meeting thereof held on September 2, 2026, proposed Local Law No. C-2026, titled, “A Local Law to Amend Chapter 235 of the Code of the Town of Marcellus to Add a New Section Regulating Battery Energy Storage Systems in the Town of Marcellus.” Said Local Law was introduced and will be considered pursuant to the provisions of the Municipal Home Rule Law. Said Local Law, if enacted, would enact battery energy storage system regulations in the Town of Marcellus. The full text of said Local Law is on file at the Town Clerk’s Office at the Town Hall located at 22 East Main Street, Marcellus, New York for inspection by all interested persons.
NOTICE IS FURTHER GIVEN that on September 2, 2026 the Town Board determined that this proposed Local Law was a Type 1 action in connection with SEQRA and determined that the Town Board will act as lead agency.
NOTICE IS FURTHER GIVEN that the Town Board will hold a public hearing on the proposed Local Law at the said Town Offices on October 7, 2026 at 6:30 p.m., or as soon thereafter as the matter can be heard, at which time all persons interested will be heard.
