NOTICE OF PUBLIC HEARING
TOWN OF MARCELLUS
NOTICE IS HEREBY GIVEN that, pursuant to Municipal Home Rule Law and Town Law, there has been presented to the Town Board of the Town of Marcellus, New York, at a regular meeting thereof held on November 4, 2026, proposed Local Law No. F-2026, titled, “A Local Law Imposing A Six (6) Month Moratorium on Battery Energy Storage Systems Within the Town of Marcellus.” Said Local Law, if enacted, would prohibit the placement, construction or erection of a battery energy storage system within the Town of Marcellus and/or the processing or further processing of such applications for a period of six (6) months. The full text of said Local Law is on file at the Clerk’s Office at the Town Hall located at 22 East Main Street, Marcellus, New York for inspection by all interested persons during regular business hours.
NOTICE IS FURTHER GIVEN that on November 4, 2026, the Town Board declared itself to be lead agency and determined that this proposed Local Law is a Type II Action and determined that the action will have no significant adverse impact on the environment for purposes of the State Environmental Quality Review Act (SEQRA).
NOTICE IS FURTHER GIVEN that the Town Board will hold a public hearing to consider proposed Local Law No. F-2026 at the said Town Hall on December 2, 2026, at 6:30 p.m. or as soon thereafter as the matter can be heard, at which time all persons interested will be heard.
